Compensation: What can be claimed?

If your personal injury claim is successful you can claim general damages which compensate you for your pain, suffering and continuing disability

You can also claim special damages in respect of any past and future financial loss.

These can include:
 

  • Travel
  • Medical expenses
  • Loss of earnings/commission/bonus, past, present and future
  • Loss of pension or reduction of pension
  • Loss of chance (eg: but for the accident the claimant had the chance of qualifying to be a drama teacher instead of clerical work at reduced pay)
  • Loss of "perks"
  • Care and assistance given by a family member or friend during your recuperation
  • The cost of employing assistance at home 
  • Loss of congenial employment (this is where you can no longer do a job you are passionate about and have trained for often for most of your working life, such as nurse, teacher, etc)
  • Purchase of various aids to assist a disabled person in the short or long term
  • Insurance excess
  • The cost of replacing services such as DIY and gardening
